上海一員工一年內因遲到被扣20萬元工資 法院:扣太多了……

用扣工資的方式防止員工遲到,是內地企業在管理時的常見做法。但是,上海有位員工卻在一年內被扣了20餘萬人民幣工資,員工不服申請了勞動仲裁。

 

 

20201130日至20211130日期間,公司依據考勤制度及江某的考勤記錄,在江某工資中實際扣款總計20.9萬元人民幣。江某申請了勞動仲裁,主張公司以多次曠工為由扣除工資於法無據,要求支付這一年內的工資差額。仲裁委裁決支持了江某的訴請,公司不服仲裁裁決,起訴至上海市黃浦區人民法院,要求不予支付。

 

黃浦法院經審理認為,用人單位可以通過規章制度規定對遲到的勞動者扣除相應未提供勞動時間對應的工資部分,但用人單位行使管理權亦應當合理且善意。用人單位規章制度中明顯擴大勞動者違紀結果、加重勞動者違紀責任的不合理規定,不能作為用人單位處罰勞動者的依據。

 

具體到本案中,醫療公司本身不具有罰款權,如為了懲罰而扣除多倍的工資,既有悖法律規定,也不符合情理。因此,按勞動者日工資扣發相應缺勤時間的工資較為公平合理。

 

結合江某的實際缺勤時間,經過核算,江某缺勤應被扣工資為1.2萬元。故江某主張公司支付工資差額,應予支持。法院遂判決公司支付江某20201130日至20211130日期間的工資差額19.6萬餘元。

 

一審判決後,雙方均未提起上訴,本案現已生效。

 

對於此案,網友雖然也認為企業的相關規定過於嚴苛,但更多網友關心這名員工薪酬究竟是多少,「一年被扣的工資比我兩年賺得多」。如果此員工年薪過百萬,必然是公司高管。眾所周知公司的出勤制度對高管是無效的,那公司以出勤制度來管理這名高管,可能目的就不是20萬的扣薪了。
